Voting: Terms and Conditions

Voting to SAVE a nominated housemate shall be by SMS, WAP and WEB, but is not possible via IVR (see How to Vote). Electronic Media Network Limited (“M-Net”) reserves the right to change the voting rules at any time, and may suspend, withdraw or re-set voting at its sole discretion.

The following rules apply to specific voting platforms:

* You can send 100 SMS votes per mobile number during each voting period, and each vote will be charged according to the Big Brother Stargame SMS Voting Table.

* Voting on the website or wapsite is free, but limited to one vote per hour during the voting period.

Vote lines will open either on Sunday night at 21:00 or on Monday night at 20:30 CAT and close on Sunday morning at 06:00 CAT. Only votes received in this period will be regarded as ‘valid votes’. SMS votes made or received outside of these times will not be counted but will be charged. This includes votes sent prior to the closing time but only received after the closing time.

After the lines have closed, the result of the vote will be established from all votes received by the producers of Big Brother Stargame(“the Producers”). Late votes, or votes not received by the time the result is calculated, will be regarded as ‘invalid votes’ and will not be counted but will be charged.

M-Net reserves the right to disqualify votes if it has reasonable grounds to suspect that fraudulent voting has occurred or if it considers that there has been any attempt to rig the voting.

Viewers’ votes will determine the eviction result. In the event that the vote outcome cannot be reasonably determined (due to a technical failure or other circumstance beyond M-Net or the Producers’s reasonable control), then the Producers will have the final say in the conclusion of the vote. The Producers’ decision will be final, and no correspondence will be entered into.

M-Net, the Producers, Multichoice Africa (Pty) Ltd, their subsidiary and holding companies, employees, directors, agents and sub-contractors (“the Indemnified Persons”), do not accept responsibility whatsoever for any technical failure or malfunction or any other problem with any mobile network, system, server, provider, software or otherwise which may result in any vote being lost or not properly received, registered or recorded or not being received on or before the closing time.

M-Net is committed to operating fair viewer voting and to preventing abuse of its systems, as well as those of its agents and sub-contractors. M-Net cannot guarantee that the mobile networks will be free from error or omissions, nor that they will be available uninterrupted and in a fully operating condition.

In the case of system failure or repair or for any reasons beyond the reasonable control of M-Net, the system and/or service may be suspended temporarily and without notice. The Indemnified Persons will not be liable to any person in the event that all or any part of the system and/or service is discontinued, modified or interrupted in any way.

You hereby release and/or indemnify the Indemnified Persons from all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of or in connection with your participation in the voting in terms hereof, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction; (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of M-Net; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

The organizers of the show retain the right to change the number of nominations and evictions within each week. Such changes will be communicated to SizweNtsalubaGobodo (responsible for verifying the interpretation of the voting each week in terms of the rules of the show). The rules regarding voting and eviction are as follows:

1.
Viewers vote for their favourite housemate. Viewers may vote using WAP, WEB and SMS. The number of votes each viewer may cast using each of these methods will be restricted. These restrictions will be determined by the organizers of the show, and will be enforced by the agents responsible for collecting and tallying the votes cast using each method. Votes cast using any of these methods will all carry equal weight, that being 1 viewer popularity vote.

2.
Within each voting region, viewer popularity votes will be tallied for each housemate eligible for eviction (or eligible for re-entry into the main house where this is applicable).

3.
For each region, the contestant with the most viewer popularity votes will receive that region’s region popularity vote.

a.
IF a tie occurs (multiple ‘most popular’ housemates within a region), the region popularity vote will be split equally between the tied contestants.


4.
Region popularity votes are tallied.


5.
The housemate(s) with the fewest region popularity votes is (are) evicted from the house. The number of housemates evicted is determined by consulting the attached document (“Content Rollout Doc 100609”) or any subsequent rules determined by the organizers of the show to replace this document.

a.
IF a tie occurs, viewer popularity votes will be tallied across all regions. The housemate(s) with the least viewer popularity votes is (are) evicted. Only the housemates tied for eviction will be up for eviction using this second round of voting. For example, if six housemates receive no country popularity votes in a week when two housemates are to be evicted, only these six housemates will be eligible for eviction using the totaled viewer votes.
